"Conference on 'Direct Taxation' "

Confederation of Indian Industry, Chennai Zone is organizing a Conference on “Direct Taxation” scheduled on 4 November 2015: 1000 Hrs at Hotel Crowne Plaza, TTK Road, Chennai. (Registration starts at 0930 Hrs).

Focus
The conference will broadly focus on the following Sessions :

Session – I : ICDS - Key issues and impact - by Mr Sriram Seshadri, Partner, Pricewaterhouse & Co LLP

With IND-AS and the IFRS based accounting standards for the corporate reporting purposes making an entry in India, the CBDT has notified tax accounting standards or Income Computation and Disclosure Standards ("ICDS") for computation of income under the head “Profits and Gains from Business or Profession” and “Income from Other Sources”. ICDS must be followed by every assesse following mercantile system of accounting and it is applicable for the current financial year 2015-16 itself. The arrival of ICDS on the scene has thrown up several challenges, such as whether ICDS will override the settled concept of 'real income' under the tax laws; provisions of ICDS which could benefit the taxpayers; Inter-play of ICDS and MAT; Impact of ICDS on changes in foreign exchange rates; treatment for items, which are not specifically dealt with under the transitional provisions etc.

This session would discuss the key issues and opportunities arising from ICDS and critical aspects such as those discussed above.

Session – II : POEM - the paradigm shift in residency test by Mr. Rishi Harlalka, Rishi Madhur & Co, Chartered Accountants

The residency test for companies has undergone a significant change with the introduction of Place of Effective Management ("POEM") as the criteria, after the amendments introduced by the Finance Act, 2015 to the Income-tax law in India. This law has thrown up a number of issues such as the Impact of POEM in the case of overseas subsidiaries of Indian companies or when significant activities of foreign companies are outsourced and carried out in India; Tax position in case of a mobile POEM or when POEM exists in multiple jurisdictions; whether taxpayers benefit by establishing POEM of foreign companies in India; Issues relating to availing Foreign Tax Credit under POEM etc.

This session would discuss issues such as the above, which would help corporates analyse the impact of POEM on their Group and identify the factors, which have to be considered by them in planning the way forward.

Session – III : Transfer Pricing - issues faced by the industry and Strategies - Speaker : Mr Madhan N, Chartered Accountant

The Transfer Pricing arena continues to evolve with issues increasing in quantum and complexity. As the industry continues to grapple with the fundamental challenge of establishing its main transactions to be at arm's length in a manner that is also acceptable to the Revenue Authorities, it is also awakening to new and multifarious issues on account of adjustments made to marketing spends, the mode of computation of capacity utilisation, adjustments on the corporate guarantees etc. ultimately culminating in litigation. While the Income-tax Appellate Tribunals ("ITATs") and the High Court ("HC"), litigations culminate with the Courts largely upholding the legal aspects, the Advance Pricing Agreement ("APA") route recognizes and advocates solutions based on the economic / business aspects of the transaction. As each approach comes with its own set of challenges, the choice of the appropriate for a to be approached is largely a business call.

This session would present an overview of the key neoteric trends and challenges faced by organizations in the manufacturing and service sector coupled with the nuances of the legal / APA forums to adjudicate on these issues and helps understanding the key aspects to be considered in adopting the right strategy.

Session – IV : A Conspectus of withholding tax issues and disallowances, by Mr Arindham Lahiri, Head of Tax (Asia Pacific), Sun Edison

Despite the plethora of precedents and interpretations, the withholding tax arena in the international, and domestic, scenario continues to remains volatile. Consequent to the retrospective amendments in the law by the Finance Act, 2012, in spite of there being no corresponding amendments to the Tax Treaties, diverging views have been taken at the level of the ITATs, even on the same underlying transaction largely owing to differences in interpretation. With the controversy still pending at the highest appellate forum, the present regime is fraught with challenges given the Revenue Authorities being obdurate in their objective to fill the exchequer's coffers at the earliest stage in any transaction. Disallowances may also have a ripple effect with the possibility of other penalties also being imposed for non-compliance.

This session would highlight the key issues and controversies on the subject to help you understand the challenges involved, in order to adopt apposite positions to withstand these challenges.

Preamble:
This seminar will look at the various issues involved in other forms of atypical working and how a business can best manage the sometimes conflicting wishes of staff with business need. Our speakers will talk about the change likely to come into effect in relation to the Flexible Working Regulations and what that will mean for your businesses.
If you have questions about part-time workers, casual workers, home workers, fixed-term contracts and/or volunteers or any other form of atypical working issues, this is the seminar for you to attend and take advantage of the opportunity to put your questions to our speakers. As an area that causes many headaches, these workshops are likely to be very popular and early booking is advised
Also, today’s organizations have a “zero tolerance” policy for sexual harassment in the workplace -- but what does that mean to you?  What exactly IS sexual harassment?  How do you make sure your conduct could never be interpreted as harassment?  How do you know if someone else’s conduct towards you constitutes sexual harassment? What are the intricate aspects of the sexual harassment act that you should know about?

Objective:

Topics:

Flexibility in Engaging Manpower

Benefits of flexible work hours or flexi-time for both employer and employees

Key issues around flexibility

Tools for managing flexible work hours

Sexual Harassment Law

  • What is sexual harassment and what conduct would fall within the definition of sexual harassment?
  • What is the protection available to men?
  • Is anti-harassment policy compulsory in view of the new enactment?
  • What should be included in an anti-harassment policy?
  • How do you know if someone else’s conduct towards you constitutes sexual harassment?
  • What are the major compliance requirements under the Act?
  • When is a complaint acceptable? etc. etc.

Take A Way
The seminar provides workable solution to keep high profile employees, whilst continue to drive performance and support business objective. Also provides solution to the problem of increasing transportation demand, congestion, energy use, and carbon emissions.

It also apprises participants about the best social etiquette that can obviate sexual harassment in workplace while interacting with colleagues of both genders.

16th - 17th July'14 at Chennai.

Waters that are used for drinking, manufacturing, farming, and other purposes by residences, institutions, hospitals, commercial and industrial establishments are degraded in quality as a result of the introduction of contaminating constituents. Organic wastes, suspended solids, bacteria, nitrates, and phosphates are pollutants that commonly must be removed.

To make wastewater acceptable for reuse or for returning to the environment, the concentration of contaminants must be reduced to a non-harmful level, usually a standard prescribed by the Environmental Protection Agency.

Sewage Treatment is the process of removing contaminants from wastewater and household sewage, both runoff (effluents) and domestic. The task of designing and constructing facilities for treating wastewaters becomes very crucial & it needs a variety of engineered and natural systems to get the job done, using physical, chemical, biological, and sludge treatment methods. Its objective is to produce a waste stream (or treated effluent) and a solid waste or sludge suitable for discharge or reuse back into the environment. This material is often inadvertently contaminated with many toxic organic and inorganic compounds.

Same Way, the effluent treatment plant is designed to treat the effluent coming from different areas of the plant. The treatment of different effluents varies with the type of effluent e.g oily water, service water coal & sludge etc.

The training would impart the basis & advance knowledge of Sewage & Effluent Treatment plants with emphasis on designing, operation, maintenance & trouble shooting. The emphasis would be on optimum system design and optimum operation and maintenance of installed units.
